SAFEKEEPING
Property held for safekeeping will be destroyed if not claimed within 60 days. Written notification is required for the items to be retained for a longer period of time. Property will generally be released to a third party with a notarized letter or an incarcerated Property Release Form (PD-203), if the owner is incarcerated. There some exceptions so please contact the Property Unit to make those arrangements.

EVIDENCE
Contact the Property Unit or Investigating Officer for release information as this may vary case by case. Generally, a court order or case adjudication is required for the release of items held as evidence.

After 60 days and prior to 90 days, contact the Property Unit for information on how to claim this property. You will need to complete a found Property Claim Form (PD-31).

STOLEN OR EMBEZZLED PROPERTY
Property has been taken from you that is allegedly stolen or embezzled. Pursuant to Penal Code Section 1413, upon the filing of a Declaration of Ownership, and after you have been given an opportunity to be heard of the matter, the property may be turned over to the person claiming to be the true owner. If criminal charges are filed, you may ask the court that hears the case to review the decision of this department concerning the return of the property.

HELD PER 5150/8102 WELFARE AND INSTITUTIONS CODE
Weapon(s) have been seized pursuant to the above laws. A court order is required for the release of the weapon(s). You must file a written request with the Cypress Police Department WITHIN 15 DAYS OF THE DATE OF THIS NOTICE if you desire the return of the weapon(s). A court date will be scheduled for you to appear before a Judge to request the weapon(s) be returned. If a request is not received within 15 days of this notice, the weapon(s) will be destroyed without further notice, in accordance with the law.

DOMESTIC VIOLENCE OR RESTRAINING ORDER VIOLATIONS
Weapon(s) have been seized for safekeeping pursuant to Penal Code Section 12028.5 and/or FC 6389(c). Prior to the release of your firearm, you will need to obtain a law enforcement gun release from the Department of Justice. This will require a background check as well. Contact the Property Unit to place a hold on your weapon(s) if you need time for the Department of Justice process to be completed.
